Notice of Making Vale of White Horse District Council (off street parking) Rye Farm and Hales Meadow, Abingdon
NOTICE IS HEREBY GIVEN that the Vale of White Horse District Council (the Council) has made the above Order, having been delegated functions under Section 101 of the Local Government Act 1972 and Section 19 of the Local Government Act 2000 and in exercise of its powers under Sections 32, 33(4) and 35 of the Road Traffic Regulation Act 1984 (the Act) and Part IV of Schedule 9 of the Act, and all other enabling powers, with the consent of Oxfordshire County Council and in accordance with Section 39(3) of the Act and after consultation with the Chief Officer of Police in accordance with Part III of the Schedule 9 to the Act, the effect of which is to regulate the use of and set the tariff of charges to be made at the Council’s off street car parks.
The Order is dated 21 June 2012 and comes into force on Friday 6 July 2012.
The Order contains various provisions concerning enforcement with regard to the operation of the car parks and enforcement in relation to payment of charges and other conditions of use.
The Council :-
a) has revoked the South Oxfordshire District Council (Off Street Parking Places)(Rye Farm and Hales Meadow Car Parks) Order 1996.
b) has made the Vale of White Horse District Council (Off-Street Parking Places)(No.1) Order 2012 that includes the following provisions that differ from previous Orders:
i) introduction of a two hour period of free parking;
ii) that a valid ticket or permit is to be displayed in vehicles during a charging period at those car parks where charges are payable, including those periods when a charge is not payable;
iii) that the Council may require the display of a valid ticket or permit in vehicles in car parks where no charge is payable
; iv) the extension of the period in which parking charges apply until 6.00 p.m.;
v) introducing a “no return†period of two hours covering all car parks in a particular town, where a vehicle has been parked for free;.
vi) charging £12 to replace a parking permit;
vii) increasing all parking charges for three hours or more by 0.30p;
viii) increasing permit costs by six per cent;
ix) that the council may suspend use of a parking space, a parking place or part thereof;
x) that the council will issue an excess charge notice when the following circumstances apply at any car park listed in the table (including those car parks not subject to parking charges): expired ticket; expired permit; no permit displayed; no valid ticket or permit displayed; permit or ticket not valid for parking place; wrong registration number on ticket; exceeded maximum stay; returned within 2 hour time limit; no valid disabled badge displayed; parked in an unauthorised area; not parked within a marked bay, exceeded weight restriction, no overnight camping. On issue of an excess charge notice, a charge of £80 becomes payable within 28 days but if the sum of £50 is paid within 10 days of the notice, the Council will accept it as full and final payment at the concessionary excess charge rate.
The charges and other conditions of use of the car parks are set out in the Schedule below.
These charges are more particularly described in the Order.
The Order and a statement of the Council’s reasons for making the Order are available for inspection at the Council offices in Abbey House, Abbey Close, Abingdon, Oxfordshire, OX14 3JE between 9:00 a.m. and 4:30 p.m. Monday to Friday.
Any person wishing to question the validity of the Order or of any of its provisions on the grounds that it or they are not within the powers conferred by the Act, or that any requirement of the Act or of any instrument made under the Act has not been complied with, may apply for the purpose to the High Court within six weeks of the date this Order is made.
